Terms of Service

Welcome to PopUp Flex. By accessing or using the App, you agree to be bound by these Terms of Service (“Terms”). These Terms govern your use of the mobile application (“App”) provided by Pink Frog Games GmbH (“Pinkfrog”, “we”, or “us”).

 

1. Use of the App

  • You must be at least 13 years old to use PopUp Flex.

  • You agree to use the App in accordance with all applicable laws and regulations.

  • You may not use the App in a way that could harm, disable, overburden, or impair the functioning of the App or other users’ enjoyment of the service.

 

2. Account, Identity, and Progression

  • You are responsible for maintaining the confidentiality of your account and device access.

  • By creating an in-app profile (e.g., nickname, avatar), you acknowledge that any information you submit must not infringe on the rights of others.

  • In-game progression, currencies (Brain$, Tag Tokens), and achievements (e.g., tags) are tied to your use of the App and are non-transferable.

  • These virtual items do not represent any monetary value and cannot be redeemed for real-world currency unless otherwise stated (e.g., SATS via ZBD integration).

 

3. In-App Purchases and Virtual Goods

  • PopUp Flex offers optional in-app purchases processed via Google Play or the Apple App Store.

  • All purchases are final and non-refundable, except as required by law.

  • Virtual items (e.g., Brain$, Boosters, Cosmetic Tags) are for entertainment purposes only and are subject to availability.

 

4. Monetization and Third-Party Services

  • PopUp Flex integrates rewarded ads, interstitials, and a third-party offer wall (e.g., Adjoe). These monetization tools may offer in-game currency or other rewards.

  • Some offer wall tasks may provide rewards via external services, such as SATS payouts through ZBD. These interactions are governed by the respective third-party terms and policies.

  • We are not responsible for the availability, accuracy, or reliability of third-party services or rewards.

 

5. Intellectual Property

  • All content within the App—including quizzes, categories, UI elements, branding, and progression systems—is owned by or licensed to Pinkfrog.

  • You may not copy, modify, distribute, or publicly display any part of the App without prior written consent.

 

6. Termination and Suspension

  • We reserve the right to suspend or terminate your access to PopUp Flex at any time, without notice, for violations of these Terms or for disruptive behavior.

  • Upon termination, any licenses or virtual content you hold will be revoked.

 

7. Disclaimer and Limitation of Liability

  • PopUp Flex is provided “as is” and “as available.”

  • We do not guarantee that the App will be error-free, uninterrupted, or meet your expectations.

  • To the extent permitted by law, we disclaim all liability for indirect, incidental, or consequential damages.

 

8. Changes to the Terms

  • We may update these Terms at any time. When we do, we will revise the “Effective Date” above and notify you via the App or app store listings.

  • Continued use of the App after any updates constitutes your acceptance of the new Terms.
